If you do not agree, do not use the Site.

1. Our Service

WanderingToes.com owns and manages all vacation rental properties listed on this website. We provide a platform for guests to browse, book, and stay in our properties. We also facilitate bookings through integrations with platforms such as Airbnb, VRBO, Booking.com, and property management tools like Guesty (or future alternatives like OwnerRes).

2. User Accounts

  • You must be at least 18 years old to use the Site.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to provide accurate, complete information and keep it updated.
  • We reserve the right to suspend or terminate accounts for violations of these Terms.

3. Bookings and Reservations

  • All bookings are subject to availability and confirmation by us.
  • Cancellation and refund policies are stated during the booking process and may vary by property.
  • You are responsible for reviewing all booking details, house rules, and occupancy limits before completing a reservation.

4. Listing Properties (for Hosts)

This section applies if you are listing a property you own that we manage. Listings must be accurate and complete. We reserve the right to remove or edit any listing that violates these Terms or applicable laws.

5. Payments and Fees

  • Payments are processed through third-party providers and integrated platforms.
  • We may charge service or booking fees, which are disclosed before checkout.
  • Payouts and refunds follow the policies of our payment processors.

6. User Conduct

You agree not to:

  • Post false, misleading, or infringing content.
  • Engage in harassment, discrimination, or illegal activities.
  • Attempt to circumvent our platform or booking systems.
  • Use the Site for any purpose other than booking or managing our vacation rentals.

7. Intellectual Property

All content on the Site (logos, text, images, etc.) is owned by us or our licensors. You grant us a worldwide, non-exclusive license to use any content you upload (reviews, photos, etc.) for operating, promoting, and improving the Site.

8. Disclaimers and Limitation of Liability

Property Condition All properties are provided “as is” with no express or implied warranties regarding condition, fitness for a particular purpose, or suitability beyond what is described in the listing. We make reasonable efforts to maintain our properties, but minor variations, maintenance issues, or changes (e.g., furnishings, amenities, or views) may occur.

Limitation of Liability To the fullest extent permitted by law, WanderingToes.com, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your booking or stay. This includes (but is not limited to) loss of enjoyment, travel expenses, or any losses resulting from property conditions, weather, natural disasters, or events beyond our reasonable control.

We are not responsible for:

  • Personal injury, illness, or death unless directly caused by our gross negligence or willful misconduct.
  • Loss, theft, or damage to your personal belongings (we strongly recommend purchasing travel insurance).
  • Disruptions due to force majeure events (e.g., hurricanes, pandemics, power outages, road closures).

Guest Responsibilities You and your traveling party assume all risks associated with the use of the property and its amenities (including pools, hot tubs, outdoor areas, or recreational equipment). You are financially responsible for any damage to the property, furnishings, or amenities caused by you, your group, or your invitees (beyond normal wear and tear). You agree to comply with all house rules, local laws, and occupancy limits.

Accuracy of Information While we strive to keep listing information, photos, and availability current, errors or omissions may occur. We reserve the right to correct them and adjust bookings as needed (with notice and options provided to you).

The Site and all properties are provided “as is” without any other warranties.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Site, your booking or stay, or your violation of these Terms.

10. Termination

We may terminate or suspend your access at any time for any reason. You may stop using the Site at any time.

11. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms with a new effective date. Your continued use of the Site after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in Forsyth County, Georgia.
